		<title>Legal Screwups: Written in Stone</title>

		<description><![CDATA[Lord, have mercy on us.  Thurgood Marshall, have mercy on us. <br /><br />Where to begin? Why not with the pilot?  Since that's all I got right now, here you go - my list of "How Badly Berlanti Screwed This Up" aka "You Can't Find One Single Competent Legal Consultant in All of Hollywood?!"<ul><li><b><i>The conflict of interest is unwaivable</i></b>. That means even if (and this is a huge freaking IF) the manufacturer client had consented to the obvious conflict of their lawyer representing the plaintiff, they couldn't have consented legally. No court would have allowed this. </li><li><b><i>No firm would have allowed it either.</i></b> This is gross malpractice, and any firm that considers itself "blue chip" would never have exposed itself to this kind of liability. (Had the manufacturer not been a client, sure - they do pro bono stuff all the time for PR purposes. But that wasn't the case here.)</li><li><b><i>Everybody who went to law school knows what a Chinese wall is</i></b>. This is a commonly discussed concept in PR (Professional Responsibility, aka Legal Ethics) classes which are usually mandatory in an ABA accredited law school. Now, it's true that California is one of a handful of states that doesn't actually require a law degree to sit for the bar exam but as far as I know you'd still have to sit for the MPRE which tests ethics knowledge - where Chinese walls are commonly tested concepts.</li><li><b><i>That ain't what the Chinese wall is, anyway!</i></b> The Chinese wall (so named for "The Great Wall of China") refers to the barrier a law firm must set up around an attorney who has a conflict of interest - that much they got right. However it's designed for attorneys who switch firms - not for attorneys who outright represent the opposing party in ongoing litigation (which - see above - is never permitted of attorneys in the same firm). It's supposed to be used in the following scenario: Lawyer A from Smith Jones, who represents Company in all matters, joins plaintiff's firm Tom & Harry LLC, who represent plaintiffs only. If a case comes up against Company, Tom and Harry MAY erect the chinese wall around Lawyer A - preventing him from having ANYTHING to do with the case, and still represent the plaintiff in the suit against Company - under some circumstances.</li><li><i><b>And Chinese walls do not remotely begin to excuse the failure to turn over ALL relevant responses to discovery requests. (i.e., the failure to disclose the report)</b></i> (added in edit)</li><li><b><i>I can't even begin to get into the evidentiary rulings in the actual litigation</i></b>. Well, OK, I'll begin: The objection to the testimony about the kid calling her Beth was laughable - I can't imagine a lawyer actually thinking that was a proper objection; it totally meets the evidentiary standard (relevant and probative, non-prejudicial).</li></ul>There's probably more but I was too dejected to keep taking notes after all that.  It's not that I am uber-picky about legal representations in TV shows, either - I mean, I totally dug The Practice as entertainment and it often got it thigh-slappingly wrong. I'm pretty lenient when it comes to that stuff. I get that you have to write a good show first. But you do NOT have to get it so mind-blowingly WRONG in order to get that good show. You can do both. It's just sloppy to do otherwise. <br /><br />Can't wait to see what they screw up next week! <br /><br />Disclaimer: ethics laws, while commonly modeled after a model set of rules promulgated by the ABA, do differ from state to state. My comments are based on foundational concepts in PR law, not any one state's laws. Still - good Lord, Berlanti. It ain't THAT hard to do a show about the law, get it right AND make it entertaining at the same time.<br /><i><br />ETA discovery error.</i>]]></description>
